My mom is being charged with embezelling $250,000 from a large insurance company. Her boss (an older, very wealthy man), let her use company credit cards to buy occasional outfits for company trips, he bought her a pool and hot tub for her yearly bonus with company credit cards, and when the company found out about it, he said he had no idea about the charges. She has like, 30 something counts against her, alot of them she has actual receipts for legitamite purchases, but if she goes to court, each count could cost her 3-6 years each. Although she could prove that she did everything with her bosses permission and knowledge, has receipts for about $20,000 of the purchases, and witnesses that saw how her boss lavished her with gifts, the risk of a high sentence is too scary to go to court, so she’s signing a plea bargain. The plea is for 18 months. I’m 17, my brother and sister are 12 and 8- do you think the judge will sympathize and give her a lesser sentence? She has no prior records.
By the way, the $20,000 in receipts is just what she had happened to have from the past few months that she hadn’t turned in yet- the remaining amount in receipts she had turned into her boss, but there were receipts for all $250,000 of it, that he “never got”.

I sure hope not.
Okay, and a quick lesson in math:
$250,000-$20,00 DOES NOT EQUAL a lot of reciepts. She’s only able to account for eight percent of her charges. I hope she gets some serious “me time” in the cooler.

I hope not. That’s total stupidity on her part for accepting all that stuff. OBVIOUSLY you can get in trouble for it. Hope she learns her lesson

Does her lawyer have no spine? Come on! If she’s got the goods on her boss being the embezzler, then the lawyer needs to be going to the mat with the judge to get her a deal to testify against the boss in exchange for immunity, or at least an even lighter sentence than 18 months.
The boss is a sleazeball and deserves to take a fall for it, ESPECIALLY considering how the S.O.B. is disclaiming all knowledge of the situation and leaving your mom hanging out to dry. If he doesn’t do some serious time himself, I hope he gets hit by a truck or something. Sheesh!!

There’s an ever so slight chance the Judge will be sympathetic. She’s signing a plea agreement that outlines what her punishment will be. The Judge isn’t bound by the agreement, so he/she can set the sentence they see fit.

It sounds like your Mom and her boss will get in trouble. No your Mom will not get out of her mistakes. What’s happened here, is they have made up a story to go along with their crime.
You are too young to worry about this, or to get involved in this. Where is your Dad? Do you have grandparents? Get out of that house and take your siblings with you. You should be worrying about college and school. Get out now!!!

Again, depends on your state, and of coarse the Judge. If the man is unwilling to testify than she needs to throw that idea out of the window. They can issue a supena to the old guy and he’ll have to come to court. Whether he tells the truth or not is another story. For her first offense, I don’t see prison time for her. But, I would get the best attorney in the county to help her. I hope she doesn’t have to go, it’s not a nice place….. been there………………20 months.

It’s a plea agreement. Court cases are settled every day by predetermining the outcome. She got 1/4 million dollars in goodies and gets to go to jail for a limited time since it was white collar. If your neighbor was stealing your food and your little brother was deathly ill from it would 2 years in jail be sufficient? Sorry, the judge could care less. I feel sorry for you and your siblings but your mother doesn’t appear to have very much character.

White collar crimes rarely result in prison time, especially if kids are involved.
House arrest is the very most I see happening.
18mos. isn’t that long a time. You’re 17 and should have no problem looking after your bro. and sis. for that amount of time.
People matter; not possessions. Learn that now and you’re way ahead of the game.
